Privacy Policy

This Privacy Policy explains how WineShapes LLC ("WineShapes," "we," "our," or "us") collects, uses, and protects your personal information when you use the WineShapes application ("App"). By creating an account or using the App, you agree to this Privacy Policy.

1. Scope, Eligibility, and Geographic Availability

The App is intended for users in the United States who are 21 years of age or older. Residents of the European Union, European Economic Area, and United Kingdom are excluded from using the App at this time. By using the App, you represent that you are a United States resident and are 21 or older. The App is rated for adults on the Apple App Store.

2. Information We Collect

A. Account Information

When you create an account using Apple Sign-In or Google Sign-In, WineShapes receives the information your sign-in provider shares, which may include your email address (Apple may provide a private relay address) and your name if you choose to share it. You will also be asked to create a username within the App — a unique handle used to identify your account. Your email address and username are stored and associated with your account.

B. Age Confirmation

Before creating an account, you must confirm that you are 21 years of age or older by tapping a confirmation in the App. WineShapes does not collect or store your date of birth. Age confirmation is used solely to restrict access to the App and is not used for any secondary purpose.

C. Contributions and App Data

WineShapes collects the content you actively submit to the App, including:

• Wine ratings — your numerical assessments of wines you have tried.
• Tasting notes — optional text notes you attach to your ratings, visible only to you.
• Drinking-window preferences — your views on when wines are ready to drink, recorded with your ratings and used only for your personal recommendations.
• Cave entries — bottles you add to your personal wine inventory, including quantity, price paid, bottle size, and personal notes.
• Top 3 wine picks and onboarding answers (wine type and typical spending range) used to set your starting palate.
• Subscription records from Apple: product, purchase and expiration dates, and transaction identifiers. We never receive payment details.
• Profile preferences and settings you configure within the App.

D. Information Collected Automatically

When you use the App, our servers receive standard technical information, including IP address, device type, operating system and App version, and request and error logs, used to operate and secure the Service. The App uses Firebase Authentication and Google/Apple Sign-In for sign-in, Apple's App Store for subscriptions, and Expo for app updates. The App contains no analytics, advertising, or crash-reporting SDKs.

E. Information We Do Not Collect

WineShapes does not collect payment card numbers, bank account information, government identification numbers, precise GPS coordinates, phone numbers, physical addresses, or date of birth. All subscription payment processing is handled entirely by Apple's App Store. WineShapes never receives or stores your payment credentials. WineShapes does not use cross-app tracking identifiers or share data with advertising networks.

3. How We Use Your Information

We use the information we collect to:

• Verify that you have confirmed you are 21 years of age or older before granting access to the App.
• Create and maintain your account.
• Compute your personalized palate profile and generate wine recommendations, match scores, and archetype classifications using our proprietary recommendation engine.
• Display your Cave inventory, Top 3 picks, and personal tasting notes to you.
• Manage your Shapes+ subscription status.
• Improve our recommendation engine, wine database, and product features using aggregated and anonymized rating data.
• Send you service communications including account confirmations and policy updates.
• Send you optional marketing communications if you have opted in.
• Display sponsored or promoted content in accordance with commercial arrangements, which will be clearly labeled in the App.
• Comply with applicable law and protect the rights and safety of WineShapes and our users.

4. Contributions — License Grant and Deletion

By submitting ratings, tasting notes, drinking-window preferences, Cave entries, Top 3 picks, and any other content to the App ("Contributions"), you grant WineShapes a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, aggregate, anonymize, analyze, and adapt your Contributions for the purpose of operating and improving the App, developing and refining our proprietary recommendation engine and wine database, and building new features and services. The perpetual license applies solely to anonymized and aggregated rating data and survives account deletion only to that extent.

Upon account deletion, WineShapes permanently deletes your personal account data, username, tasting notes, Cave entries, Top 3 picks, drinking-window preferences and other personal affinities, palate profile, match scores, and personal preferences within 30 days. WineShapes retains the right to continue using anonymized and aggregated rating data — without drinking-window answers, notes, or any personal identifiers — already incorporated into the recommendation engine and wine database, from which your personal identity cannot be reasonably re-identified.

You represent and warrant that: (a) you own or have the right to submit your Contributions; (b) your Contributions do not infringe any third-party rights; and (c) your Contributions do not contain false, misleading, or unlawful content.

5. How We Share Your Information

Service Providers: We engage third-party service providers to operate the App, including infrastructure and hosting providers, database services, authentication services, and other operational vendors. These providers process data on our behalf under appropriate data processing agreements and are prohibited from using your data for their own independent purposes.

Sponsored and Partner Content: WineShapes may enter into commercial arrangements with wine producers, retailers, and related commerce platforms. Sponsored or promoted content will be clearly labeled within the App. WineShapes does not share your personal information with advertising networks as part of any such arrangement.

Legal Compliance: We may disclose information if required by law, court order, or government authority, or to protect the rights, property, or safety of WineShapes, our users, or the public.

Business Transfers: If WineShapes is acquired, merged, or sold, your information may be transferred as part of that transaction. We will notify you of any material change.

We do not sell your personal information. We do not share your personal information with third parties for their independent marketing purposes or for cross-context behavioral advertising.

6. Your Choices and Rights

Marketing Opt-Out

You may opt out of marketing communications at any time by following the unsubscribe instructions in any marketing message or by contacting us at gabriel@wineshapes.app.

Account Deletion

You may delete your account directly within the App through the account settings menu. Account deletion is also available by contacting gabriel@wineshapes.app. Upon deletion, WineShapes permanently deletes your account data, username, tasting notes, Cave entries, Top 3 picks, drinking-window preferences and other personal affinities, palate profile, match scores, and personal preferences within 30 days. Anonymized and aggregated rating data already incorporated into the recommendation engine is retained as described in Section 4. Deleting your account does not cancel your Shapes+ subscription; cancel it separately in your App Store account settings.

California Privacy Rights (CPRA)

California residents have the following rights under the California Privacy Rights Act: (1) the right to know what personal information we collect, use, share, and sell; (2) the right to delete personal information we have collected; (3) the right to correct inaccurate personal information; (4) the right to opt out of the sale or sharing of personal information for cross-context behavioral advertising; (5) the right to limit the use and disclosure of sensitive personal information to the purpose for which it was collected; and (6) the right to non-discrimination for exercising these rights. WineShapes does not sell personal information and does not share personal information for cross-context behavioral advertising. To exercise your rights, contact gabriel@wineshapes.app.

7. Device Storage and Tracking

WineShapes stores essential data on your device including authentication tokens, session state, ratings cache, and app preferences necessary for the App to function. WineShapes does not use analytics trackers, advertising trackers, cross-app tracking identifiers, or third-party tracking SDKs. We do not sell or share your data with advertising networks. If we introduce optional analytics or advertising tracking in the future, we will update this Privacy Policy and provide appropriate notice before enabling such tracking.

8. Data Security, Retention, and Breach Notification

We implement reasonable technical and organizational safeguards to protect your personal information. No security system is completely secure and we cannot guarantee absolute security of your information.

We retain your personal information for as long as your account is active or as needed to operate the App and comply with legal obligations. Upon account deletion, your personal data will be permanently deleted within 30 days as described in Section 4.

In the event of a data breach reasonably likely to result in harm to affected users, WineShapes will notify affected users and applicable regulatory authorities as required by applicable US state breach notification laws.

9. Children and Minors

The App is intended exclusively for users 21 years of age or older. We do not knowingly collect information from anyone under 21. The App requires age confirmation before registration to restrict access. Account holders are responsible for ensuring that minors do not access the App on their devices. If we become aware that a user under 21 has accessed the App, we will promptly delete that account and associated information. 10. Third-Party Links and Services

The App may contain links to third-party websites or services, including wine commerce partners. This Privacy Policy does not apply to third-party services. We encourage you to review the privacy policies of any third parties you access through the App.

11. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes we will notify you by email or by prominent in-App notice at least 14 days before the change takes effect. Continued use of the App after the effective date constitutes acceptance of the updated policy.
